1. ABOUT ACE OF SPORTS(AoS) AND THESE TERMS

1.1. These Terms and Conditions (Terms) govern your access to and use of the Ace of Sports platform and website located at https://www.aceofsports.com/ (the Platform), operated by Ace of Sports (Ace of Sports, AoS, we, us, our).

1.2. Ace of Sports is a sports engagement, rewards and membership platform with an online shop. Users can:
(a) join sports tipping leagues;
(b) earn points and “Tickets” through participation and other in-platform actions; and
(c) access and purchase sports-related products through our shop (including trading card boxes, memorabilia, collectibles and related items), including member-only offers and ticket redemptions/discounts (where applicable).

1.3. AoS does not offer wagering or betting services. You do not place bets or stake money on individual outcomes through the Platform. Prize draws are operated as promotional trade promotion lotteries in connection with our memberships and shop offerings.

1.4. From time to time, AoS may run promotions (including prize draws and giveaways) to promote awareness and engagement with AoS services and the shop. Promotion availability may vary by jurisdiction and by membership tier, and not all tiers will have an active draw at all times. Each promotion will have its own Promotion Rules that apply in addition to these Terms.

1.5. By creating an account, purchasing a membership or using the Platform, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.

1.6. We may update these Terms from time to time. When we do, we will post the updated Terms on the Platform with a new “Last updated” date. Your continued use of the Platform after changes are posted means you accept the updated Terms.

1.7. These Terms should be read together with our Privacy Policy and any specific promotion rules that apply to particular giveaways or draws. If there is a conflict between these documents, promotion rules apply for that promotion, and the Privacy Policy applies to privacy matters.

2. ELIGIBILITY AND ACCOUNTS

2.1. The Platform is intended for individuals aged 18 years or over. By creating an account or using the Platform, you represent and warrant that you are at least 18 years of age and are legally permitted to use the Platform under the laws of your place of residence.

2.2. We do not actively verify your age at sign-up. However, we may request evidence of age at any time and may suspend or close accounts where we reasonably believe a user is under 18 or otherwise ineligible.

2.3. The Platform is primarily designed for Australian residents. Users from other countries may be able to access the Platform, but it is your responsibility to ensure your use is lawful where you reside, and you acknowledge that certain promotions, giveaways or features may be restricted or unavailable to non-residents or to residents of particular states or territories if required by law or permit conditions.

2.4. You must create an account using accurate and current information, including a valid email address. You are responsible for maintaining the confidentiality of your login details and for all activity that occurs under your account.

2.5. You must notify us promptly if you become aware of any unauthorised access to your account.

2.6. We may, acting reasonably, suspend or terminate your account and/or invalidate entries or tickets if we suspect breach of these Terms, fraudulent, misleading, manipulative or abusive behaviour, unfair advantage through bots, scripts, collusion or multi-accounting, or any conduct that undermines the integrity of tipping, tickets, draws or the Platform.

2.7. PROMOTIONS AND JURISDICTION AVAILABILITY

2.7.1. Certain promotions (including giveaways and prize draws) are only available in jurisdictions where we are permitted to run them and, where required, have obtained approvals/permits/authorities.

2.7.2. Current excluded jurisdictions (giveaway promotions not available): Australian Capital Territory (ACT) and South Australia (SA) unless and until we confirm availability for that jurisdiction in the applicable Promotion Rules and/or on the Platform.

2.7.3. If a promotion is not available in your jurisdiction, you must not enter, and any entry associated with an ineligible jurisdiction will be invalid and may be redrawn in accordance with the relevant Promotion Rules.

2.7.4. We may apply reasonable technical and procedural controls (including declarations, residency checks, IP/location indicators, and winner verification) to help enforce jurisdiction restrictions.

2.7.5. Your eligibility for a promotion may be assessed at entry, at the relevant cut-off, and/or at winner verification. We may require proof of residency and eligibility before awarding a prize.

2.8. We may change membership tiers, benefits and promotions from time to time. Changes will take effect from the date they are published. We will not make changes that materially disadvantage eligible entrants in an active promotion and will provide an appropriate remedy where required by law.

3. NATURE OF OUR SERVICES (NOT GAMBLING OR WAGERING)

3.1. AoS provides:
(a) sports tipping and engagement features (free to use, subject to eligibility);
(b) a rewards system (points and Tickets); and
(c) an online shop with member and non-member purchase pathways, including member-only offers and ticket redemption/discount options (where applicable).

3.2. Membership fees (where applicable) are paid for access to membership services and shop benefits. Entries to promotions (where offered) are not sold separately as a gambling product and are intended to be incidental promotional benefits to AoS services.

3.3. No odds, betting markets or stakes per event are offered through the Platform. You do not wager or place bets with AoS.

4. MEMBERSHIPS AND PACKAGES

4.1. AoS offers different membership tiers (for example, Bronze, Silver and Gold) and may introduce or retire tiers over time.

4.2. When you purchase a membership package, unless otherwise stated, your package is prepaid and runs for 12 months from the date of purchase (Membership Term), and your package benefits apply for the full Membership Term.

4.3. Packages are generally non-refundable for change of mind once purchased. This does not affect any rights you may have under the Australian Consumer Law if there is a major failure in the services provided.

4.4. During your Membership Term you may receive, depending on your tier and current offers:

(a) access to member features;
(b) access to member-only shop items and offers (where applicable);
(c) the ability to redeem Tickets for certain shop items and/or apply Tickets as discounts (where applicable and subject to rules displayed on the Platform);
(d) enhanced ticket/points earning rates or multipliers (where offered); and
(e) promotional benefits such as eligibility for certain member promotions/draws only where offered in eligible tier, in available jurisdiction, subject to the relevant Promotion Rules.

4.5. Sign-up Ticket bonus (Paid Members): On purchase of a membership package, we may allocate sign-up Tickets to your account as follows (unless stated otherwise on the Platform):
(a)Bronze: 20 Tickets
(b)Silver: 50 Tickets
(c)Gold: 100 Tickets

4.6. We may offer renewal options for memberships. If we introduce auto-renewal, we will clearly disclose this and how to cancel before any renewal is processed.

4.7. Memberships are personal to you and are not transferable or assignable.

5. POINTS, TICKETS, SHOP REDEMPTIONS AND TIPPING

5.1  Points and tickets

5.1.1. As you use the Platform, for example by joining leagues and submitting tips, you may earn points and/or tickets.

5.1.2. Depending on your membership tier, you may have ticket multipliers or enhanced earning rates.

5.1.3. Points and tickets have no cash value, cannot be redeemed for money or credited to a account or card, cannot be sold, transferred or assigned except as specifically allowed by us, and may expire or be forfeited if your account is closed or if we reasonably believe they were earned in breach of these Terms.

5.2.  shop redemptions

5.2.1. At all membership tiers, some or all products in the AoS shop may be redeemable using tickets only. We may set the number of tickets required for each item, change available items and ticket “prices” over time, and provide a range of items at different ticket levels, including some that require a relatively low number of tickets.

5.2.2. Some items may be available only for ticket redemption and not for direct cash purchase. Others may be available through different mechanics, which will be explained on the Platform.

5.2.3. Only package holders can redeem tickets for shop savings; free users can earn tickets but not redeem them.

5.2.4. When you redeem tickets for a product, the relevant number of tickets will be deducted from your account. The redemption is treated similarly to a shop purchase for fulfilment and consumer law purposes, including where a product is faulty or not as described.

5.2.5. Where an order has any delivery fee component, delivery fees may still be payable even if Tickets are used for redemption/discount (as displayed at checkout).

5.2.6. Ticket “prices” (tickets required for an item), item eligibility, discount caps and redemption mechanics may change from time to time. The shop display at the time of redemption governs the tickets required and any ticket-discount limits.

5.3.  TIPPING (FREE) + LEAGUES

5.3.1. Participation in tipping leagues is free for all eligible users (Free Members and Paid Members).

5.3.2. Purchasing a membership package is not required to participate in tipping, and tipping participation is not conditional on buying a package.

5.3.3. Any tipping prizes/competitions (if offered) will be governed by the applicable rules for that competition.

5.3.4. AoS also runs tipping leagues and leaderboards that are games of skill, where outcomes are determined by participant performance under stated rules (not by random draw).

5.3.5. Skill-based leagues and prizes (if offered) are governed by the applicable league/competition rules shown on the Platform, including scoring and tie-break rules.

6. GIVEAWAYS, PRIZE DRAWS AND Promotions

6.1  General

6.1.1. AoS may run promotions including Monthly Package Draws for eligible tiers. Promotions are governed by its Promotion Rules, unless expressly stated in the Promotion Rules, entries are not sold separately. Monthly Package Draws may not be offered for all tiers at all times.

6.1.2. Each promotion or draw has its own specific Promotion Rules, published on the Platform or linked from it. These rules cover eligibility, entry method, opening/closing times, draw details, prizes, winner notification, prize claim process, and redraws.

6.1.3. If there is any inconsistency between these Terms and a set of Promotion Rules, the Promotion Rules prevail for that promotion.

6.1.4. Promotion availability by jurisdiction (State exclusions)
(a) Promotions are only open to residents of jurisdictions where we are permitted to run the promotion and (where required) where we have obtained approvals/permits/authorities.
(b) Unless and until we confirm otherwise, Bronze draws are not available to residents of SA and ACT.
(c) We may verify residency and eligibility at entry and/or during winner verification. If a promotion is not available in your jurisdiction, any associated entry will be invalid and we may redraw in accordance with the applicable Promotion Rules.

6.1.5. Winner notification & verification: We may require winners to verify identity, age and residency. If a winner is ineligible, we may withdraw the prize and redraw in accordance with the Promotion Rules.

6.2. Entries and cost

6.2.1. Unless expressly stated otherwise, entries into AoS prize draws are not sold separately. Any entry is offered only as an incidental promotional benefit of holding an account, holding an eligible membership package (if that tier is offering an active draw at the relevant time), and/or engaging with Platform features, as set out in the relevant Promotion Rules.

6.2.2. Membership fees are paid for access to membership benefits (including shop access, member-only items/offers, and ticket redemption/discount functionality). They are not paid as a fee to enter a draw.

6.2.3. No separate entry fee is charged to enter any draw. Membership fees (if applicable) are paid for access to the Promoter’s membership services and shop benefits, and are not charged for the purpose of entering a draw. Standard internet/device costs may apply.

6.2.4. In some cases, and where stated in the promotion rules, AoS may also allow one entry per eligible user into a particular draw, regardless of membership tier or ticket or points balance, to keep specific promotions simple and conservative.

6.2.5. No entry fee / membership value. AoS does not charge a separate entry fee to participate in a draw. Where entry is obtained by purchasing goods or services (including a membership), this is permitted only where the goods or services are supplied at their normal price and the promotion is conducted to genuinely promote AoS goods or services, in accordance with applicable laws and any permit or authority conditions.

6.3.  Draw conduct and randomisation

6.3.1. We will conduct prize draws using a fair and random method, which may include a reputable random number generator or other randomisation tools.

6.3.2. For larger prizes, we may have an independent or internal witness present or record the draw process, and we will keep appropriate records of entries and results in line with our legal obligations and permit conditions.

6.3.3. Our decision regarding the conduct of draws and the selection of winners is final, subject to any requirements of regulators or courts.

6.4.  Winner notification, verification and prize delivery

6.4.1. Winners will be notified using the contact details associated with their account, for example by email. You are responsible for keeping your contact details up to date.

6.4.2. We may require winners to verify their identity and age, confirm eligibility, and provide a suitable address for prize delivery.

6.4.3. If we cannot contact a winner after reasonable attempts, if a winner does not complete verification within a reasonable time, or if a winner is found to be ineligible by law or under the promotion rules, we may be required to forfeit the prize and redraw or follow any alternative procedure required by law or permit conditions.

6.4.4. If you were an eligible member at the time of the draw, your entitlement to the prize does not depend on you keeping an active paid membership after that draw. We will not require you to renew or re-purchase a membership as a condition of accepting a prize, although certain logistical costs, such as travel to a prize collection point where applicable, may still be your responsibility.

6.5.  Jurisdiction and “void where prohibited”

6.5.1. Some draws or promotions may be subject to state, territory or international restrictions. Where we are not permitted to offer a draw in a particular jurisdiction, entries from that jurisdiction will be invalid, and we may be required to redraw.

6.5.2. We may geoblock or apply other technical or procedural restrictions to minimise the risk of ineligible entries. It is still your responsibility to ensure that your participation is legal where you reside.

6.5.3. If a winner is later found to be ineligible by law, for example because the promotion could not lawfully be conducted in their jurisdiction, AoS may be required to withdraw the prize and redraw. In such cases, we may choose, but are not obliged, to offer a goodwill gesture.

6.6.  Monthly Package Draws

6.6.1 If AoS offers Monthly Package Draws for a tier, they are promotional games of chance governed by their Promotion Rules and may be limited to eligible paid package holders at specified cut-off times. Monthly Package Draws may not be offered for all tiers at all times.

6.6.2 Where Monthly Package Draws are offered for a tier, an eligible paid package may result in entry into multiple scheduled draw months for that tier during the stated promotion period, subject to the rules for cut-offs and “no backdating” (as set out in the Promotion Rules).

6.6.3 Each package tier may be limited to one purchase per account for the relevant season/period, and entry may be limited to one entry per tier per draw month (as set out in the Promotion Rules), where that tier is offering an active Monthly Package Draw.

6.7.  Changes, suspension and discontinuation of promotions

6.7.1 AoS may update, modify, suspend or discontinue membership tiers, benefits, and promotions (including Monthly Package Draws) from time to time.

6.7.2 Any change will apply prospectively from the time it is published on the Platform.

6.7.3 Where a change affects an active promotion for which eligible entries have already been received, AoS will not make changes that materially disadvantage eligible entrants and will provide any remedy required by law (for example rescheduling, substitution of an equal or greater prize, or refunds where applicable).

6.8.  “When you win, your friend wins too” (Referrer Bonus)

6.8.1 From time to time, AoS may offer promotions where, if a primary winner wins a prize, a referrer may also receive a bonus prize (a Referrer Bonus).

6.8.2 A referrer relationship is valid only if it is correctly recorded by the Platform in accordance with the applicable Promotion Rules by the relevant cut-off time for that promotion.

6.8.3 If the Promotion Rules provide for a Referrer Bonus, then where the primary winner has an eligible referrer recorded at the relevant cut-off, the referrer will receive the Referrer Bonus Prize (subject to eligibility and verification).

6.8.4 Where the primary winner has no recorded referrer, or the recorded referrer is ineligible, no Referrer Bonus Prize will be awarded, unless the applicable Promotion Rules expressly state otherwise. For clarity, this does not affect the award of the primary winner’s prize.

6.8.5 AoS may refuse to award a Referrer Bonus where we reasonably believe there has been fraud, self-referral, duplicate accounts, manipulation or abuse of the referral system.

6.3.1. We will conduct prize draws using a fair and random method, which may include a reputable random number generator or other randomisation tools (www.Randomdraws.com).

6.3.2. For larger prizes, we may have an independent or internal witness present or record the draw process, and we will keep appropriate records of entries and results in line with our legal obligations and permit conditions.

6.3.3. Our decision regarding the conduct of draws and the selection of winners is final, subject to any requirements of regulators or courts.

7. SHOP PURCHASES, PRICING AND RETURNS

7.1  Shop purchases

7.1.1. You may be able to obtain products through the AoS shop by redeeming tickets (tickets-only items) or by other mechanics described on the Platform.

7.1.2. Prices (whether in tickets or cash) and product availability are subject to change at any time.

7.1.3. We use Stripe to process payments for any cash components. By making a purchase, you agree to Stripe’s processing of your payment information.

7.2. Returns, refunds and the Australian Consumer Law

7.2.1. Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. If there is a major problem with a product or service, you may be entitled to a refund, replacement or other remedy.

7.2.2. Generally, we are not required to offer a refund or replacement if you simply change your mind. However, we may do more than the law requires as a goodwill gesture in some cases.

7.2.3. If an item is faulty, unsafe, significantly different from its description or otherwise fails to meet consumer guarantees, we will provide an appropriate remedy in line with the law, such as repair, replacement, refund or compensation, as applicable.

7.2.4. To request a remedy, contact us at support@aceofsports.com with your order details, a description of the issue and any relevant photos or supporting information.

7.2.5. Nothing in these Terms is intended to exclude or limit your non-excludable rights under the Australian Consumer Law.

8. MEMBERSHIP REFUNDS AND CANCELLATION

8.1. Membership packages are generally non-refundable for change of mind. If you decide you no longer want to use the Platform, or you do not win a prize, this does not usually entitle you to a refund of membership fees.

8.2. If there is a major failure in the membership services we provide, for example the core features do not work and cannot be remedied within a reasonable time, you may be entitled to cancel your membership and obtain a refund for the unused portion, or to seek another remedy under the Australian Consumer Law.

8.3. If you cancel or if we close your account, we may close your access to membership features and future draws, and any future entries, tickets or benefits that depend on an active membership may cease. Subject to the law and any promotion-specific rules, entries in draws already conducted while you were eligible remain valid and any prizes already awarded or owing are not automatically forfeited.

9. USER CONDUCT AND FAIR PLAY

9.1. You must use the Platform in a fair, lawful and responsible manner. You must not create multiple accounts for yourself, impersonate another person or misrepresent your identity, use bots, scripts or automation to submit tips or earn tickets or entries, interfere with or manipulate tipping, leaderboards, draws or ticket allocations, attempt to reverse engineer, hack or disrupt the Platform or its security, or use the Platform for any unlawful purpose.

9.2. We may investigate suspected breaches and, acting reasonably, may adjust or cancel points, tickets or entries, exclude you from specific promotions, or suspend or close your account.

10. INTELLECTUAL PROPERTY

10.1. The Platform and all content on it, including our logo, branding, graphics, text, icons and interface elements, are owned or licensed by AoS and are protected by intellectual property laws.

10.2. You are granted a limited, non-exclusive, non-transferable licence to access and use the Platform for personal, non-commercial purposes in accordance with these Terms.

10.3. You must not, without our prior written consent, copy, reproduce or redistribute substantial parts of the Platform or its content, use our trademarks, branding or logos in a confusing or misleading way, or create derivative works from or exploit the Platform or its content for commercial gain, except as expressly allowed.

11. THIRD-PARTY SERVICES AND LINKS

11.1. The Platform may integrate with or link to third-party services, including payment gateways such as Stripe, hosting providers such as AWS, and external websites.

11.2. We are not responsible for the content, security or privacy practices of third-party services. Your use of those services may be subject to separate terms and policies.

11.3. You access third-party sites and services at your own risk.

12. LIABILITY AND DISCLAIMERS

12.1. To the maximum extent permitted by law, and except for your non-excludable rights under the Australian Consumer Law, we exclude all warranties, representations and guarantees not expressly stated in these Terms, and we are not liable for any indirect, special or consequential loss, loss of opportunity or loss of profits arising out of or in connection with your use of the Platform, memberships, shop purchases, draws or promotions.

12.2. Where our liability cannot be excluded under the Australian Consumer Law but can be limited, our liability is limited, at our option, to re-supplying the relevant services or paying the cost of having the services re-supplied.

12.3. We are not responsible for delays or failures in performance due to events beyond our reasonable control, errors or omissions in content provided in good faith, or issues arising from your failure to keep your contact information up to date.

12.4. Nothing in these Terms is intended to exclude or limit any rights or remedies you may have under the Australian Consumer Law that cannot lawfully be excluded or limited.

13. CHANGES TO THE PLATFORM

13.1. We may add, change, suspend or remove features, events, draws, product offerings or other parts of the Platform at any time.

13.2. Where a significant change materially affects an existing membership or promotion, we will take reasonable steps to notify affected users and, where required by law or fairness, provide appropriate remedies, such as adjusted entries, alternative prizes or partial refunds.

14. GOVERNING LAW AND DISPUTES

14.1. These Terms are governed by the laws of Victoria, Australia. You submit to the non-exclusive jurisdiction of the courts of Victoria and the courts of appeal from them.

14.2. If you have a concern or dispute with us, you should first contact us so we can try to resolve it informally. If it cannot be resolved, you may have the right to escalate the matter to a consumer protection agency or tribunal.
